Terms of Service

The agreement between you and Dainty when you use our platform.

Introduction

Dainty operates a marketplace connecting performing artists with event organisers and venues. By creating an account or using dainty.app, you agree to these Terms. If you do not agree, do not use Dainty.

These Terms apply to all users — artists, venues, organisers, and anyone browsing the platform. Additional terms may apply to specific features such as payment processing, governed by our Stripe agreement.

Definitions

Artist means any performer, DJ, band, or act that lists their services on Dainty.

Booker means any event organiser, venue, or individual who uses Dainty to request or book Artists.

Engagement means a confirmed booking agreement between an Artist and a Booker facilitated through the Platform.

Platform means dainty.app and any associated mobile applications, APIs, and services.

Service Fee means the commission Dainty charges on completed Engagements.

Eligibility

You must be at least 18 years old to use Dainty. By using the Platform, you represent that you are of legal age and have the legal capacity to enter into binding contracts in your jurisdiction.

Businesses using Dainty must be duly incorporated and authorised to do business. You are responsible for ensuring your use of the Platform complies with all applicable laws in your territory.

Accounts & Profiles

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Report any suspected unauthorised access through the app.

You may not create more than one account per person without our prior written consent. We reserve the right to suspend or terminate accounts that violate these Terms.

Artist profiles are publicly visible. By publishing a profile, you grant Dainty a non-exclusive licence to display your profile content to Bookers and in promotional materials for the Platform.

Bookings & Engagements

Inquiry: A Booker submits an inquiry specifying event details. No contract exists at this stage.

Quote: The Artist responds with a quote. The quote constitutes an offer.

Acceptance: The Booker selects a package and initiates payment. This constitutes acceptance and creates a binding Engagement.

Confirmation: Dainty confirms payment and issues the digital contract to both parties. The Engagement is now confirmed.

Artists and Bookers are solely responsible for the performance of their obligations under an Engagement. Dainty is a marketplace and not a party to the contract between Artist and Booker.

Payments & Fees

Payments are processed by Stripe, Inc. By using payment features, you also agree to Stripe's Terms of Service. Dainty charges a platform service fee on each completed Engagement, deducted automatically from the Artist's payout.

Payouts to Artists are released 48 hours after the confirmed event date, contingent on no active dispute. Dainty holds funds in escrow during the Engagement period.

All prices are displayed in the currency shown on the quote. Dainty is not responsible for currency conversion losses.

Cancellations & Refunds

Cancellation by Booker: If a Booker cancels more than 30 days before the event, the Booker receives a 50% refund. Cancellations within 30 days are non-refundable unless the Artist agrees otherwise.

Cancellation by Artist: If an Artist cancels a confirmed Engagement, the Booker receives a full refund. Repeated cancellations may result in account suspension.

Force Majeure: Neither party is liable for failure to perform due to circumstances beyond their reasonable control, including natural disasters, government orders, or public health emergencies. Dainty will facilitate a fair resolution on a case-by-case basis.

Disputes

Either party may open a dispute within 7 days of the event date through the Contracts section of the app. Dainty will investigate and issue a determination within 14 business days. Dainty's determination is final for amounts below €2,000.

For amounts exceeding €2,000, unresolved disputes may be referred to the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

Prohibited Conduct

You may not use Dainty to:

  • Circumvent the Platform by arranging bookings directly after initial contact through Dainty (first-contact protection: 12 months)
  • Post false, misleading, or fraudulent listings
  • Harass, threaten, or discriminate against other users
  • Scrape, reverse-engineer, or copy Platform content
  • Use Dainty to facilitate illegal activities
  • Impersonate another person or entity

Violation may result in immediate account termination and legal action.

Intellectual Property

Dainty and its operator own all intellectual property rights in the Platform, including the Dainty brand, software, design, and content we create.

Content you upload (photos, bios, music samples) remains yours. You grant Dainty a worldwide, royalty-free licence to use, display, and reproduce this content for the purposes of operating and promoting the Platform.

Limitation of Liability

To the maximum extent permitted by law, Dainty's total liability for any claim shall not exceed the greater of (a) €100 or (b) the total service fees paid by you in the 12 months preceding the claim.

Dainty is not liable for loss of profits, loss of data, indirect or consequential damages, or damages arising from your interactions with other users.

Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under German law.

Governing Law

These Terms are governed by German law. The place of jurisdiction is Frankfurt am Main, Germany, except where mandatory consumer protection laws in your country grant you the right to bring claims in local courts.

If you are a consumer based in the EU, you may benefit from mandatory protections under the law of your country of habitual residence, which these Terms do not override.

Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email at least 14 days before they take effect. Your continued use of the Platform after the effective date constitutes acceptance of the updated Terms.
